“Prudent Industry Practice” means those practices, methods, equipment, materials, specifications and standards of safety and performance engaged in or approved by a significant portion of the relevant industry during the relevant time period immediately preceding the initiation of any relevant portion of the work in respect of the design, engineering or construction (as applicable) of electric power generation facilities similar to the power plant, which in the exercise of professional judgment and in light of the facts known at the time that the relevant work was initiated were considered good, safe and prudent in connection with the design, engineering or construction of facilities similar to the power plant with commensurate standards of safety, performance, dependability, efficiency, and economy, and as are in accordance with generally accepted standards of professional care, skill, diligence, and competence applicable to design, engineering and construction practices in the United States. Prudent Industry Practices is not intended to be the optimum practice, method or acts to the exclusion of all others, but rather is intended to be any of the practices, methods or actions generally accepted in the United States that meet the foregoing standards.
